Heidi Klum is taking a lead from Kate Middleton after topless pictures of the model were posted by a French magazine recently. Meaning, she's suing. Probably.

The mom of four was with her boyfriend/bodyguard, sans bikini top, and the resulting paparazzi pictures wound up in a French publication and all over the Internet. The model mom of four is not amused. So, she's taking a page out of Kate Middleton's book and is mulling over filing a lawsuit for invasion of privacy, reports TMZ.

However, it could be a bit trickier than the royal war on sunbathing pictures. Apparently Klum's camp is having trouble tracking down which magazine published the topless pictures first so they're on a massive hunt to find the source of the shots.

Waiting to pull out the big le! gal guns might be smart on the model's part, though. If Middleton's lawsuit is successful, it will be much easier for Klum to establish precedent and nab a victory of her own. For now, perhaps the gals can meet up and discuss alternatives to topless tanning.
